Privacy Policy
This policy explains what Talos Dataworks, Inc. (“Talos”) collects through the Talos glove, wrist box, app, data services and this website, how we use and sell it, and the choices people have. We sell and license recorded data. Please read Section 4 closely. Recordings made under a signed Talos Electrician Agreement are covered by our Recording Data Policy instead. Read the Recording Data Policy
1. Who this covers
1.1People this policy covers. This policy covers visitors to this website; people who buy the Equipment; people who wear or record with it (“Authorized Users”); and people who are seen or heard in a recording, or whose property appears in one (“Recorded People”).
1.2Ownership. Under our Terms & Conditions, Talos owns all lawful data captured on our equipment, including data from people who have no other relationship with us. Words used in capitals here, such as Captured Data, have the meanings given in those Terms. Ownership does not take away any privacy right that the law gives you, and nothing in this policy does either.
1.3Where we operate. Our products are offered only in the United States, and we store and process data in the United States. They are not directed to people in the European Economic Area, the United Kingdom or Switzerland.
2. What we collect
2.1Order and account details. Your name, email, shipping address, company, type of work, camera choice, what you ordered, invoices and payment records, and anything you tell us in a message or form.
2.2Early interest. If you go through our checkout before kits are on sale, we collect your name, email, ZIP code and the items you chose. We do not ask for payment details, and no order is placed.
2.3Your acceptance of our terms. The version of our Terms & Conditions and this policy that you accepted, the date and time, and your IP address, so that we can prove the agreement.
2.4Captured Data. Video, stereo and depth imagery; sound, if recorded; head and wrist motion; the position and movement of the hands and fingers; fingertip and palm force readings; timestamps and calibration records; device identifiers and logs; and labels describing the work. This may show other people, property, documents or places, even though our Terms tell Authorized Users to keep them out.
2.5Hand, voice and movement data. Some laws, including those of Illinois, Texas and Washington, treat some of this as biometric or otherwise sensitive information. We collect it only for the purpose in Section 3. We do not use it to identify anyone.
2.6Consent records and location. Copies of consents and releases, including names and signatures, and general facts about a recording such as type of work, experience, handedness, glove size, and the city and ZIP code. We do not intentionally store street addresses with recordings.
2.7App and device data. Technical details needed to run the app and pair devices, such as device type, operating system, app version, crash logs and connection status. We will ask for permission before the app uses your camera, microphone, Bluetooth or location.
2.8Website data. If you sign up for updates, your email address. Our hosting and email delivery providers process standard technical data, such as IP address and browser type, to deliver and secure the site. This site uses no advertising or analytics cookies.
3. How we use it
3.1Captured Data. To build, license and sell datasets that teach artificial-intelligence, robotic and training systems how work is done, and to clean, label, annotate, redact, quality-check, store and package them. We may also use it to develop and improve our own products and models.
3.2Your details. To measure demand for our products and tell you when kits are ready to buy, to take and fulfill orders, invoice you, provide the app and data services, give support, send safety and service notices, and send marketing if you signed up, which you can stop at any time.
3.3Legal and safety. To enforce our agreements, keep proof of consents, prevent fraud and misuse, respond to claims and legal requests, and comply with the law.
4. How we sell and share data
We sell Captured Data. Under some state laws, this counts as a “sale” of personal information to the extent the data identifies someone.
4.1Companies that license our data. We sell and license Captured Data and Derived Data to companies that build artificial-intelligence, robotic and training systems. They may license it onward, through any number of tiers, and we will not necessarily know who those companies are.
4.2Authorized Users. Under our Terms, Authorized Users receive a license to data from their own Equipment and may sell or license it to others. They are responsible for what they do with it.
4.3What licensees do not get. We identify Authorized Users to licensees only by a pseudonymous ID and general facts such as type of work, experience, handedness and glove size. We do not give licensees names or contact details, or sell your email address or shipping address.
4.4Service providers. Companies that help us run our business, such as hosting, storage, email delivery, annotation, payment and shipping providers, under terms limiting how they use the data.
4.5Legal and business transfers. Courts, regulators, law enforcement or others when we believe the law requires it or it is needed to protect rights or safety, as our Terms describe. We may also transfer data in a merger, sale, financing or similar transaction.
5. Our protections for people in recordings
5.1Never used to identify anyone. We do not use recordings to identify, verify, authenticate, track or profile anyone, and we do not create faceprints, voiceprints, hand-geometry scans, templates or any other identifier for recognizing a person.
5.2Blurring and muting. When data passes through our Data Services, we aim to blur the faces of people other than the wearer, mute third-party conversations, and remove legible names, addresses and license plates before it leaves Talos. Automated tools can miss things. Data that an Authorized User exports directly from their own device has not been through this process, and they are responsible for it.
5.3The same rules downstream. Our Terms and our data licenses forbid identifying anyone, and require anyone who receives the data to accept the same rules.
5.4No one under 18. Our Terms forbid recording anyone under 18. Our products are not directed to children, and we do not knowingly collect data from anyone under 18. If you believe a recording shows a child, tell us and we will remove it.
6. If you appear in a recording
6.1How recording works. Talos sells equipment. People who buy it choose when and where to record, and many have no other relationship with us. Our Terms require them to get written consent from property owners and from anyone clearly seen or heard, but Talos does not attend their jobs or check every consent in advance, and it does not hold recordings that are never sent to it. Those people are responsible for the recordings they make and hold, and you may have rights against them directly.
6.2Ask us to remove it. If you think you or your property appears in a recording, or you did not consent, contact us with the date, place and any other details that can help us find it. Any faces and conversations we hold in error will be removed within 30 days of our confirming them, and we will require licensees to do the same. We cannot remove what has already become part of a trained system.
7. How long we keep it
7.1Captured Data and Derived Data. For as long as we use it for the purposes in Section 3. We review what we hold at least every three years, and permanently delete recordings we no longer license or plan to license. Copies already licensed are governed by the license terms.
7.2Biometric information. Any information that a law treats as biometric is destroyed when the purpose for collecting it has been satisfied, or within three years of the person's last interaction with Talos, whichever comes first, unless the law requires otherwise.
7.3Improper or illegal data. Deleted once Talos decides it should not be held, unless the law, a legal hold or a claim requires us to preserve it or report it.
7.4Consent records. While any recording they cover is held or licensed, and for seven years after that.
7.5Order and account records. For as long as you have an account, and for seven years after your last order for tax, accounting and legal purposes.
7.6Website messages and signups. For as long as we need them to reply to you, or until you unsubscribe.
8. Security
8.1How we protect data. We store recordings and identity records with encryption and access limited to the staff who need them, with at least the care we use for our own confidential information. No system is completely secure, and we cannot guarantee security. If the law requires us to notify you of a breach, we will.
9. Your privacy rights
Depending on where you live, including California, Utah and other states with privacy laws, you may have the rights below.
9.1Your rights. You may have the right to know what personal information we collect and how we use and share it; to access, correct or delete it; to get a portable copy; to opt out of its sale, sharing for targeted advertising, or use for certain profiling; and to limit our use of sensitive personal information. We do not use personal information for targeted advertising.
9.2Opting out of sale. To opt out of the sale of your personal information, contact us through the privacy request form or by email. Removing your information from future sales does not recall data already licensed, except as the law requires.
9.3How to make a request. Use the privacy request form on our contact page, or email wyatt@talosdataworks.com. We will verify your request, reply within the time the law allows, and tell you how to appeal if we decline. You may use an authorized agent where the law allows.
9.4Limits on these rights. The law allows us to decline some requests, for example where we must keep information for legal reasons, or cannot match pseudonymous data to you. We will tell you when that happens.
9.5No retaliation. We will not discriminate against you for using your privacy rights.
10. Other choices
10.1Marketing. You can unsubscribe from marketing email at any time. We may still send you service, safety and legal messages.
10.2Cookies and tracking. This site uses no advertising or analytics cookies, and it does not respond differently to browser “Do Not Track” signals because it does not track you across other sites.
10.3Other websites. Links to other sites, such as camera makers, are governed by those sites' own policies.
11. Changes and contact
11.1Changes. We may change this policy by posting a new version with a new date. If a change is material, we will give reasonable notice.
11.2Contact. Privacy questions or requests go to Wyatt Searle, Chief Executive Officer, Talos Dataworks, Inc., wyatt@talosdataworks.com.
